Acceptance of Terms

By accessing, using, copying, modifying, or distributing this software, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this License.

Restrictions on Use

Without prior express written authorization from AStheTech, you shall not, directly or indirectly:

• Sell, license, sublicense, lease, or otherwise commercially exploit the software or any derivative work thereof.
• Offer, provide, or make available the software as part of any hosted service, SaaS platform, API service, or similar commercial offering.
• Rebrand, white-label, or distribute the software under a different name or identity for commercial advantage.
• Use the software to develop, operate, or support any product or service that is substantially similar to or competitive with AStheTech's offerings where such use is commercial in nature.
• Remove, alter, obscure, or misrepresent any proprietary notices, including copyright, license, or attribution statements.

Any use not expressly permitted under this License shall be deemed a material breach.

Commercial Use

Any use of the software for commercial purposes, including but not limited to monetization, resale, licensing, or integration into commercial products or services, is strictly prohibited unless authorized under a separate written agreement with AStheTech.

If you distribute the software or any modifications thereof, you must:

Ownership and Intellectual Property

Termination

This License shall automatically and immediately terminate, without notice, upon any breach of its terms.

Upon termination, you shall immediately cease all use of the software and any derivative works, and shall promptly destroy or permanently delete all copies of the software in your possession or control, including any modified versions.

Termination of this License shall not limit any rights or remedies available to AStheTech under applicable law. AStheTech expressly reserves the right to pursue all legal and equitable remedies in the event of a violation of this License.

Disclaimer of Warranties

The software is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties or conditions of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by applicable law, AStheTech expressly disclaims all warranties, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.

You assume all risks associated with the use of the software, including but not limited to risks related to performance, security, data loss, and compliance with applicable laws.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall AStheTech, its affiliates, or its licensors be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever, including but not limited to damages for loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with this License or the use or inability to use the software.

This limitation shall apply regardless of the legal theory under which such liability is asserted, whether in contract, tort (including negligence), strict liability, or otherwise, and even if AStheTech has been advised of the possibility of such damages.

Governing Law

This License shall be governed by and construed in accordance with the laws applicable to AStheTech's principal place of business, without regard to its conflict of law provisions.

You agree that any disputes arising out of or in connection with this License shall be subject to the exclusive jurisdiction of the competent courts located within such jurisdiction.

Entire Agreement

This License constitutes the complete and exclusive agreement between you and AStheTech with respect to the software and supersedes all prior or contemporaneous agreements, communications, representations, or understandings, whether written or oral, relating to its subject matter.

No amendment or modification of this License shall be valid unless made in writing and expressly authorized by AStheTech.

License Intent

This License is intended to enable broad access to and use of the software for personal, educational, and internal business purposes, while preserving AStheTech's exclusive rights to commercially exploit, license, and control the software.

Any interpretation of this License shall be made in a manner consistent with this intent, ensuring that commercial rights remain solely with AStheTech unless explicitly granted.
